Kakime Terms of Service

Welcome to Kakime — Singapore’s buddy-finder for sports kakis. By creating an account or using the App, you agree to these Terms. Read them carefully.

If you do not agree, please stop using the App and uninstall it.

1. About Kakime

Kakime is a mobile application operated by the Kakime team in Singapore (contact: hello@kakime.sg). The App lets users:

• Find sports buddies (“kakis”) by sport, skill, and home area;
• Post photos and videos (“Highlights”) to a shared feed;
• Showcase or sell sports gear;
• Organise games and pick-up sessions;
• Chat directly with matched users;
• Read AI-summarised Singapore sports news.

1.1 Feature Limits & Technical Discretion

To keep Kakime affordable to run and fair to everyone, we set reasonable technical limits on user contributions. In particular:

• Highlights are user-uploaded video clips capped at a maximum of 15 seconds each.
• Kakime reserves the right to compress, transcode, limit, or remove content that exceeds this duration cap, uses excessive server or bandwidth resources, or otherwise threatens the stability or economics of the App.
• Feature limits may change from time to time as Kakime evolves; the version described here reflects the current MVP baseline.

2. Eligibility

• You must be at least 13 years old.
• Users aged 13-17 require parental or guardian consent.
• You must provide accurate information when registering.
• You may not use the App if you have been previously banned, or if your country, region, or institution prohibits this service.

3. Your Account

• You are responsible for the activity on your account and for keeping your credentials confidential.
• Use of Sign in with Apple is supported. We do not see your real Apple ID email unless you allow it.
• One person, one account. Bots, automated agents, and shared accounts are prohibited.
• We may suspend or terminate accounts that violate these Terms or that we reasonably believe are fraudulent, fake, or harmful.

4. Acceptable Use — What You May Not Do

You agree NOT to:

• Post content that is illegal, obscene, sexually explicit, hateful, harassing, defamatory, infringing, or threatening.
• Solicit minors, share personal data of others without consent, or promote violence.
• Impersonate any person or misrepresent your affiliation with any organisation.
• Scrape, crawl, reverse-engineer or otherwise extract data from the App at scale.
• Use the App to send spam, MLM offers, gambling promotions, or unsolicited advertising.
• Bypass safety features, paywalls, or rate-limits.
• Upload viruses, malware, or anything that interferes with the App’s operation.
• Use the App for commercial buddy-matchmaking, escort services, or any sexual solicitation.
• Post content containing copyrighted music, tracks, or audio recordings for which you do not hold the necessary licence or permission. You are strongly encouraged to use original audio (natural game sounds, your own voiceover) or clearly royalty-free tracks only.
• Post photos or videos of other individuals — including opponents, teammates, spectators, coaches, umpires, or players on adjacent courts — without their explicit consent. By uploading, you warrant that every person visible or audible in your content has agreed to be featured on Kakime.

Violations may result in immediate account termination, content removal, and (where appropriate) referral to the Singapore Police.

5. User Content & Intellectual Property Safe Harbour

• You retain ownership of the photos, videos, captions, and messages you create.
• You grant Kakime a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and distribute your content solely to operate and improve the App — e.g. caching it on Cloudinary, showing it to other users, including it in moderated highlight reels, sharing thumbnails via deep links.
• This licence ends when you delete the content or your account.
• You represent that you own (or have permission to share) every piece of content you upload.
• We may remove content that violates these Terms without notice.

5.1 Copyright & Trademark Takedown Notice

Kakime respects intellectual property rights. If you believe any content hosted on the App infringes your copyright or trademark, please send a written Notice of Infringement to hello@kakime.sg containing:

1. Identification of the copyrighted work or registered trademark being infringed;
2. The specific location within Kakime (screen name, post ID, URL, or screenshot) of the allegedly infringing material;
3. Your full name, official contact email, and a good-faith statement that the use is not authorised by the rights-holder or law;
4. A statement, made under penalty of perjury, that the information in the notice is accurate.

Upon receipt of a compliant notice, Kakime reserves the right to remove or disable access to the flagged content immediately without prior notice to the uploader. We may also terminate accounts of users who are repeat infringers. Counter-notices from the affected uploader may be sent to the same email.

6. Moderation & Reporting

• Users can report inappropriate content via the in-app … menu.
• Reports trigger admin review; we aim to resolve within 24-48 hours.
• Repeat offenders are subject to escalating sanctions: warning → temporary suspension → permanent ban.
• We do not pre-moderate every upload but reserve the right to remove anything that breaches these Terms.

7. Buddy Matching, Real-World Meetups & Physical Risk Waiver

• No Guarantor or Chaperone: Kakime provides software to help sports enthusiasts discover each other. We do not perform background checks, identity verification, or on-site chaperoning of any user, venue, coach, shop, or organiser.
• Meet safely: Always meet in public sporting venues, share your plans with a trusted contact, and trust your instincts. Verified Shop Application status does not imply endorsement of products or services sold.
• Assumption of Risk: Participation in real-world sports sessions, pick-up games, tournaments, coaching, and meetups arranged via Kakime carries inherent risks of physical injury, illness, property loss, or personal dispute. You agree that you join all offline activities voluntarily and at your own risk.
• Waiver of Liability: To the maximum extent permitted under Singapore law, you agree that Kakime, its founders, operators, volunteers, and contributors shall not be held liable for any personal injury, accident, illness, theft, harassment, loss, or property damage sustained during offline meetups, sports sessions, or interactions between users introduced through the App.

7.1 Peer-to-Peer Gear Showcase & Exchanges

• No Marketplace Intermediary: The Gear section lets users showcase and voluntarily arrange exchanges or sales of sports equipment among themselves. Kakime is not an e-commerce platform, payment processor, escrow service, listing agent, or broker of any kind.
• Off-Platform Transactions: Any payment, trade, delivery, or transfer of gear is conducted strictly between the involved users and outside the App. Kakime does not hold funds, process transactions, or verify the condition, authenticity, safety, legality, or value of any listed item.
• No Liability for Disputes: Kakime disclaims all liability for financial losses, non-delivery, damaged goods, counterfeit items, misrepresentation, or fraudulent transactions arising from peer-to-peer gear exchanges. Any dispute is strictly a private matter between the users involved.

8. Subscriptions & Payments

The core Kakime experience is currently free. If we introduce paid features, those will be disclosed clearly and governed by Apple/Google in-app-purchase rules. You can manage and cancel subscriptions inside iOS Settings → Apple ID → Subscriptions, or in the Google Play Store.

9. Intellectual Property

• The Kakime name, logo, mascot illustrations, and original UI artwork are owned by the Kakime team and protected by copyright and trade-mark law.
• You may not use Kakime branding without prior written permission.
• Third-party trademarks (sports brands, equipment makers) are the property of their respective owners.

10. Privacy

Your use of the App is also governed by our Privacy Policy. By using Kakime, you consent to the data practices described there.

11. Disclaimers

• The App is provided “as is” and “as available” without warranties of any kind.
• We do not warrant that the App will be uninterrupted, error-free, or completely secure.
• To the maximum extent allowed by Singapore law, we disclaim all implied warranties including merchantability, fitness for a particular purpose and non-infringement.

11.1 Hobby Service Notice

Kakime is a passion project — built and maintained by sports lovers in Singapore in our spare time, funded out of our own pockets. It is not a venture-backed company, not a full-time business, and not staffed by a 24/7 operations team. We pour our best effort into keeping Kakime reliable, safe, and useful for our community.

That said, you should know:

• We may need to pause, suspend, or permanently close the service for reasons including (but not limited to) financial constraints, time and operational limits, technical issues, regulatory changes, hosting-provider changes, or simply because we can no longer sustain the project responsibly.
• The service is offered without any guarantee of continued availability, uptime, or service level.
• By using Kakime, you agree that Kakime, its founders, contributors, volunteers, and operators shall not be held liable for any inconvenience, lost opportunity, data unavailability, third-party costs, or other consequences arising from downtime, scheduled or unscheduled maintenance, partial service degradation, or permanent closure of the service.

If we ever need to wind the service down, we will do our best to give you reasonable advance notice and a way to export your content where practical and legally possible. Until that day, we'll keep doing our best — because that's the only reason Kakime exists in the first place.

12. Limitation of Liability

To the maximum extent permitted by Singapore law:

• Kakime, its founders and contributors are not liable for indirect, incidental, consequential, special or punitive damages.
• Our total aggregate liability for any claim arising out of or relating to the App is capped at SGD 100 or the amount you paid us in the prior 12 months, whichever is greater.

12.1 User Indemnity

You agree to indemnify, defend, and hold harmless Kakime, its founders, operators, volunteers, and contributors from and against any and all claims, demands, damages, losses, liabilities, settlements, fines, and legal fees (including reasonable lawyers' fees and record-label / rights-holder / third-party costs) arising out of or connected to:

• Your breach of these Terms (including the Acceptable Use rules in Section 4);
• Your content — in particular, any allegation that your Highlights, gear listings, chat messages, or profile media infringe someone's copyright, trademark, publicity or privacy rights, including claims from music labels, artists, agencies, or persons filmed without consent;
• Your conduct on or off the App with other users introduced through Kakime (see Section 7);
• Any peer-to-peer gear transaction you enter into with another user (see Section 7.1);
• Any misrepresentation you made when creating your account or content.

This obligation survives termination of your account. Kakime reserves the right (at your expense) to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defence.

13. Termination

• You may delete your account at any time (Profile → Settings → Delete my account).
• We may suspend or terminate your access if you breach these Terms.
• Sections 5 (licence), 9 (IP), 10 (privacy), 11-13 (disclaimers, liability, termination), 14 (governing law) survive termination.

14. Governing Law

These Terms are governed by the laws of the Republic of Singapore. Any dispute is subject to the exclusive jurisdiction of the Singapore courts.

15. Changes

We may amend these Terms from time to time. Material changes will be announced in-app and via email at least 7 days before they take effect. Continued use of the App after the effective date constitutes acceptance.
